Fairfax Immigration Attorney Discusses Family Based Green Card Process

Shahina Khatun

A lawyer for Fairfax VA immigration Johnson & Masumi recently posted a blog discussing the “How to Apply for a Family Green Card” issue for family members traveling to the USA.

Because of the limitations of the Immigration and Citizenship Law on the number of family green cards that are issued to foreign nationals every year, there are strict rules that determine which family members are eligible to receive a green card. The U.S. Citizenship and Immigration Services (USCIS) regulates who qualifies for this, based on a progression of criteria. However, the only relatives you can petition in the United States are your spouse, any unmarried children under the age of 21. This process can take years, as the next of kin is the first priority.

Initial step to submitting a family green card is to submit Form I-130, which is a petition for foreign relatives. If the application is endorsed, the relative will apply for a legal permanent residence with a visa number. Following step is to affirm that you are a permanent resident of the United States. You will then provide evidence that you have a relationship with this relative through a marriage certificate, birth certificate and related supporting document.

Finally, you will provide evidence of any change in legal name for you or a member of your family. Family green cards fall into preference categories one through four, which you should also consider.
